Voice Data Policy

Effective Date: June 20th, 2026

1. Overview

This Voice Data Policy explains how Sayak AI (“Sayak,” “we,” “our,” or “us”) handles your voice when you use Ava, our voice AI tutor. It supplements our Privacy Policy; where this policy is silent, the Privacy Policy applies.

To use Ava, Sayak will access your device microphone and process your voice in real time. You are asked to agree to this policy before voice capture begins, and you can decline and type to Ava instead.

2. What We Collect

Your voice input during Ava sessions
Text transcripts of your conversation (retained for 30 days, then deleted)
Session duration and usage metadata

3. What We Do Not Do

We do not store audio recordings after your session ends
We do not create voice prints or biometric profiles
We do not sell your voice data to third parties

4. How Your Voice Is Processed

Your voice is streamed to our AI providers in real time so they can generate Ava's spoken responses. Audio is processed transiently to produce a reply and is not retained as a recording once the session ends. Providers act on our behalf under their own data-processing terms and are not permitted to use your voice to build biometric profiles.

5. Retention

Audio: not stored after the session ends.
Transcripts: retained for 30 days to support the service, then deleted.
Usage metadata (e.g. session duration): retained as described in our Privacy Policy.

6. Your Choices

Voice capture starts only after you agree to this policy. Until then, your microphone stays off.
You can decline and use Ava by typing instead of speaking.
You can mute the microphone at any time during a session.

Part 1 — Terms of Service Addendum: Voice Features

The following provisions supplement the Sayak AI Terms of Service (the ‘Terms’) and govern your use of voice-enabled features, including Ava the AI Voice Tutor (‘Voice Features’). By using Voice Features, you agree to these additional terms. In the event of any conflict between these provisions and the main Terms, these provisions shall control with respect to Voice Features.

1. Voice Feature Eligibility and Age Restrictions

1.1 Minimum Age Requirement

Voice Features are available only to users who are thirteen (13) years of age or older. Users between the ages of thirteen (13) and seventeen (17) (‘Minor Users’) may only access Voice Features with verified parental or legal guardian consent as described in Section 1.2 below.

1.2 Parental Consent for Minor Users

If you are a Minor User, you represent and warrant that:

Your parent or legal guardian has reviewed and consented to your use of Voice Features;
Your parent or legal guardian understands that voice data will be collected and processed as described in this Addendum and in the Privacy Policy;
You have obtained your parent or legal guardian’s permission before activating microphone access on your device.

Sayak Labs LLC reserves the right to require verifiable parental consent and to suspend access to Voice Features for any Minor User pending verification.

1.3 User Representations

By activating Voice Features, you represent and warrant that:

You meet the minimum age requirements set forth in Section 1.1;
You are the authorized account holder;
You have the legal right and authority to provide the consents required by this Addendum;
You are not located in a jurisdiction where the collection of voice data is prohibited by applicable law.

2. Grant of License to Process Voice Data

2.1 Limited Processing License

By using Voice Features, you grant Sayak Labs LLC and its authorized AI service providers a limited, non-exclusive, non-transferable, revocable license to:

Capture real-time audio input transmitted through your device microphone during active Voice Feature sessions;
Transmit your audio input to third-party AI processing services for the sole purpose of generating responses through the Ava AI Voice Tutor;
Generate and temporarily retain transcripts of your Voice Feature sessions as described in Section 3 of this Addendum;
Use aggregated, de-identified session metadata (such as session duration and feature usage frequency) to improve service performance.

2.2 Scope Limitations

This license is expressly limited as follows:

Sayak Labs LLC does not use your voice input to create voice prints, voiceprints, biometric templates, or other biometric identifiers;
Sayak Labs LLC does not sell, lease, trade, or otherwise profit from your voice data or biometric information;
Sayak Labs LLC does not use your voice data to train AI models without your separate explicit written consent;
The license granted herein applies solely to Voice Features and does not extend to any other product, service, or purpose.

3. Data Retention and Deletion

3.1 Audio Recordings

Sayak Labs LLC does not retain raw audio recordings of your voice sessions beyond the duration of the active session. Audio data transmitted for real-time processing is not stored in retrievable form by Sayak Labs LLC after your session ends.

3.2 Session Transcripts

Text transcripts generated from your voice sessions may be retained for a period of up to thirty (30) days from the date of the session (‘Retention Period’). Transcripts are retained for the following purposes:

To enable session continuity and contextual responses within the same study session;
To allow you to review prior Ava conversations within your account;
To detect and prevent misuse of Voice Features in accordance with our Terms of Service.

Upon expiration of the Retention Period, transcripts are permanently and irreversibly deleted from Sayak Labs LLC’s systems and from the systems of any third-party sub-processors.

3.3 Metadata

Non-content session metadata — including session timestamps, duration, device type, and feature usage frequency — may be retained for up to twelve (12) months for service analytics and improvement purposes. This metadata does not contain the content of your voice sessions or any biometric identifiers.

4. Biometric Information — Illinois Residents

4.1 BIPA Compliance Notice

If you are a resident of the State of Illinois, the following provisions apply to you in addition to all other provisions of this Addendum, pursuant to the Illinois Biometric Information Privacy Act (740 ILCS 14/1 et seq.) (‘BIPA’).

4.2 Nature of Data Collected

Sayak Labs LLC collects and processes voice data solely for the purpose of providing real-time responses through the Ava AI Voice Tutor. Sayak Labs LLC does not collect, store, or use voice prints or biometric identifiers derived from your voice data.

4.3 Retention Schedule

In compliance with BIPA Section 15(a), Sayak Labs LLC hereby publishes the following retention schedule for voice-related data from Illinois residents:

Raw audio input: Not retained beyond the active session (deleted in real time upon session end);
Session transcripts: Retained for a maximum of thirty (30) days from session date, then permanently destroyed;
Session metadata: Retained for a maximum of twelve (12) months, then permanently destroyed;
All voice-related data is destroyed within three (3) years of the user’s last interaction with Voice Features, or upon account deletion, whichever is earlier.

4.4 Prohibition on Sale

Sayak Labs LLC will not sell, lease, trade, or otherwise profit from any biometric data or voice data collected from Illinois residents, in compliance with BIPA Section 15(c).

4.5 Third-Party Disclosure

Sayak Labs LLC discloses voice data to third-party AI service providers solely for the purpose of processing Voice Feature requests. Such disclosures are made pursuant to written agreements that obligate third parties to maintain confidentiality and comply with applicable biometric information privacy laws. Illinois residents may request a list of third-party sub-processors by contacting privacy@sayak-ai.com.

5. Two-Party Consent — Applicable States

5.1 Recording Consent

Certain US states — including but not limited to California, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington — require the consent of all parties to a conversation before a recording may be made (‘Two-Party Consent States’).

By using Voice Features, you acknowledge and consent to the capture and processing of your voice input for the purpose of enabling Ava AI Tutor responses. This consent satisfies the two-party consent requirement in all applicable jurisdictions. You represent that you are recording only your own voice and that no other parties are being recorded without their consent.

6. Third-Party AI Service Providers

6.1 Sub-Processors

Your voice input is transmitted in real time to one or more third-party AI service providers (‘Sub-Processors’) for the purpose of generating Ava’s responses.

6.2 Data Processing Agreements

Sayak Labs LLC has entered into Data Processing Agreements (‘DPAs’) with each Sub-Processor listed above. These DPAs require Sub-Processors to:

Process your voice data only for the purpose of providing Voice Features;
Maintain appropriate technical and organizational security measures;
Delete your data upon completion of processing or upon Sayak Labs LLC’s instruction;
Comply with applicable data protection laws including GDPR, CCPA, and BIPA.

7. Changes to This Addendum

Sayak Labs LLC reserves the right to modify this Addendum at any time. If we make material changes to how we collect or process your voice data, we will:

Provide at least thirty (30) days’ advance notice via email to your registered address;
Display a prominent in-app notification prior to the effective date of the change;
Require you to re-confirm your consent to Voice Features before the new terms take effect.

Your continued use of Voice Features after the effective date of any amendment constitutes your acceptance of the amended Addendum.
